By creating an account or using the Cargo Commander mobile application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

Cargo Commander is a logistics platform that connects shippers who need goods transported with independent drivers and carriers who provide transportation services. We facilitate communication, booking, tracking, and related features but are not a carrier, freight forwarder, or employer of drivers.

3. Eligibility and Accounts

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your information if it changes

You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

4. Shipper Responsibilities

If you use the Service as a shipper, you agree to:

• Provide accurate shipment details, including pickup and delivery locations
• Ensure goods are properly packaged, labeled, and lawful to transport
• Not request transport of prohibited, hazardous, or illegal items
• Be available at agreed pickup and delivery times
• Pay applicable fees as agreed for completed shipments

5. Driver Responsibilities

If you use the Service as a driver, you agree to:

• Hold valid licenses, permits, and insurance required by applicable law
• Provide accurate vehicle, identity, and registration documentation
• Transport goods safely, lawfully, and in accordance with agreed terms
• Maintain your vehicle in roadworthy condition
• Comply with all traffic, customs, and transport regulations

6. Acceptable Use

You may not use the Service to:

• Violate any applicable law or regulation
• Submit false, misleading, or fraudulent information
• Harass, abuse, or harm other users
• Interfere with or disrupt the Service or its security
• Reverse engineer, scrape, or misuse the platform without authorization

We reserve the right to suspend or terminate accounts that violate these rules.

7. Payments and Fees

Certain features of the Service may involve fees, bids, or payments between users. Pricing, payment methods, and billing terms will be displayed within the app or agreed between parties for each shipment.

Cargo Commander may charge platform or service fees as disclosed at the time of booking. You are responsible for any taxes applicable to your use of the Service.

8. Cancellations and Disputes

Cancellation policies and dispute resolution procedures may vary depending on shipment status and user role. Users should attempt to resolve disputes directly through the Service where available.

Cargo Commander may, at its discretion, assist in resolving disputes but does not guarantee a particular outcome.

9. Intellectual Property

The Service, including its software, design, logos, and content, is owned by Cargo Commander or its licensors and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Cargo Commander disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted access, error-free operation, or the conduct, reliability, or performance of any user.

11. Limitation of Liability

To the fullest extent permitted by law, Cargo Commander and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claim relating to the Service shall not exceed the amount you paid to Cargo Commander in the twelve (12) months preceding the claim, or one hundred dollars (USD $100), whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Cargo Commander from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, pose a risk to other users, or if required by law.

Provisions that by their nature should survive termination — including limitations of liability, indemnification, and intellectual property — will remain in effect.

14. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Cargo Commander operates, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts in that jurisdiction, unless otherwise required by applicable law.
